NotiAlarm Terms of Service
Last updated: 2026-10-22
These Terms of Service ("Terms") are an agreement between you and AYYEEHHM DESIGNS LLC, a New York limited liability company ("we", "us"), which operates NotiAlarm. They cover the NotiAlarm apps for iPhone, iPad, Apple Watch, Mac, Android and Wear OS, our website, and the backend that receives your alerts (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
Please read section 12. It requires most disputes to be resolved by individual arbitration rather than in court or as a class action, and explains how to opt out.
1. Who can use NotiAlarm
You must be at least 13 years old. If you are under 18 (or the age of majority where you live), you may use NotiAlarm only with the permission of a parent or guardian who agrees to these Terms for you. You're responsible for the accuracy of your account details and for everything that happens under your account.
2. What NotiAlarm does — and what it can't promise
NotiAlarm turns alerts from services you connect (webhooks, forwarded emails, calendars, phone notifications, heart rate devices and others) into alarms on your devices. Every alarm depends on systems we don't control: the service that sends the alert, email providers, internet and cellular networks, Apple's and Google's push services, your device's operating system, its battery and power settings, Focus/Do Not Disturb and volume settings, and the permissions you grant.
Because of that, we cannot guarantee that any alert will be received, that any alarm will ring, or that it will ring on time. Alarms can be late, silent, or missed entirely — for example when your phone is off, offline or out of battery, when an alert arrives more than 10 minutes late, or when a third-party service fails to send it. Keep a backup for anything that matters.
Not for emergencies, medical or safety use
NotiAlarm is not a medical device, not an emergency or life-safety system, and not a substitute for one. Do not rely on it as your only means of learning about a medical condition (including glucose, heart rate or medical-alert events), a fire, intrusion or other safety event, or any situation where a missed or late alarm could cause injury, death or property damage. In an emergency, call your local emergency number.
Not financial advice
Trading, market and Polymarket alarms only relay alerts and public data. Nothing in NotiAlarm is investment, financial or trading advice, and we are not responsible for any trade you make or miss.
3. Your account and your webhook URLs
- Keep your password and sign-in methods secure. Tell us at support@notialarm.com if you think your account has been compromised.
- Your webhook URLs and NotiAlarm email addresses work like passwords: anyone who has one can make your alarms ring and can subscribe to that source. Share them only with services and people you trust. You can rotate a URL in the app at any time, which disconnects everyone using the old one.
- When you share a source with other people, you're responsible for the alerts it sends them.
4. Free plan, Pro and payments
- NotiAlarm has a free plan with limits shown in the app, and a paid subscription ("Pro"). Features, limits and prices are shown in the app before you buy and may change; changes to a subscription's price apply only from your next renewal and as the app store allows.
- Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), under their terms. A subscription renews automatically at the end of each period until you cancel it in your Apple ID or Google Play subscription settings at least 24 hours before the period ends. Deleting the app or your account does not cancel it.
- If a free trial is offered, you're charged when it ends unless you cancel before then.
- Refunds are handled by Apple or Google under their policies; we can't issue refunds for purchases made through them.
- We may give some accounts Pro access for free at our discretion; it can be ended at any time.
5. Your content, including uploaded sounds
"Your content" means the sounds you upload, alarm and source names, and other material you put into NotiAlarm. You keep all rights you have in it. You give us a limited, worldwide, non-exclusive, royalty-free license to store, copy, convert and transmit your content only as needed to run the Service for you — including playing your sounds on your devices and, when you share an alarm or source, on the devices of the people you share it with. This license ends when you delete the content or your account, except for copies in routine backups that expire on their normal schedule.
Only upload sounds you have the right to use. By uploading, you confirm that you own the sound or have permission to use it this way, and that it doesn't infringe anyone's copyright or other rights. We don't review uploads, and we may remove any content that we believe violates these Terms or the law.
6. Acceptable use
You agree not to:
- upload or share content that infringes someone else's rights, or that is unlawful, harassing or abusive;
- use NotiAlarm to harass, disturb or spam other people, or ring anyone who hasn't agreed to receive your alerts;
- send alerts at volumes meant to overload the Service, get around rate limits, plan limits or other restrictions, or access accounts, URLs or data that aren't yours;
- probe, scan or test the Service's security without our written permission (report vulnerabilities to support@notialarm.com instead), or reverse engineer it except where the law allows;
- resell the Service or use it to build a competing service, or use it in breach of any law or of a third party's terms.
7. Copyright complaints (DMCA)
We respect copyright and respond to notices of claimed infringement under the U.S. Digital Millennium Copyright Act. If you believe content stored through NotiAlarm infringes your copyright, send a written notice to our designated agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the infringing material and enough information for us to locate it; (4) your name, address, phone number and email; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner.
Designated agent: Copyright Agent, AYYEEHHM DESIGNS LLC, 350 Northern Blvd STE 324-1737, Albany, NY 12204, USA · support@notialarm.com (subject line "DMCA").
If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice with the information required by 17 U.S.C. § 512(g)(3). We will terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.
8. Third-party services
NotiAlarm works with services run by others — for example TradingView, Gmail, Polymarket, IFTTT, Apple and Google. Your use of those services is governed by their own terms, and we are not responsible for them, their availability, or changes they make. Some optional setup features (such as Automated setup on TradingView) act on a third-party site at your request; using them is your choice and your risk under that site's terms, as described in the in-app disclaimer.
9. Disclaimers
TO THE FULLEST EXTENT ALLOWED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT ANY ALERT WILL BE DELIVERED OR ANY ALARM WILL SOUND.
10. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, LOST OPPORTUNITIES, DATA OR GOODWILL, INCLUDING ANY LOSS CAUSED BY AN ALERT OR ALARM THAT WAS LATE, MISSED, SILENT OR WRONGLY TRIGGERED; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR US$50.
Some places don't allow these exclusions or limits, so some of them may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a consumer that cannot be waived.
11. Indemnity
To the extent allowed by law, you agree to defend and indemnify us against claims, damages and costs (including reasonable legal fees) arising from your content, your misuse of the Service, or your violation of these Terms or of anyone else's rights.
12. Disputes: informal resolution and arbitration
Talk to us first. Before filing any claim, email support@notialarm.com with a description of the problem and give us 30 days to try to resolve it.
Arbitration. If we can't resolve it, you and we agree that any dispute relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small-claims court, and either of us may seek an injunction in court for infringement or misuse of intellectual property. The Federal Arbitration Act governs this section. The arbitration may be conducted by video or phone, or in the county where you live.
No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not consolidate claims of more than one person.
Opting out. You can opt out of this arbitration agreement by emailing support@notialarm.com from your account's email address within 30 days after you first agree to these Terms, with the subject "Arbitration opt-out". If you opt out, or if this section is found unenforceable, disputes will be resolved in the state or federal courts located in Albany County, New York, and you and we consent to their jurisdiction.
13. Ending your use
You can stop using NotiAlarm and delete your account at any time (Settings → Delete Account, or see our support page). We may suspend or end your access if you violate these Terms, if required by law, or to protect the Service or other users. We may also change or discontinue features, or the Service, at any time. Sections 5 (the last paragraph), 9, 10, 11, 12 and 15 survive the end of these Terms.
14. If you got NotiAlarm from the Apple App Store
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for NotiAlarm and its content. Apple's standard Licensed Application End User License Agreement also applies; if it conflicts with these Terms, these Terms control to the extent allowed.
- Your license to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store's Usage Rules.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the extent allowed by law, Apple has no other warranty obligation for the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer-protection or privacy claims. Apple is not responsible for investigating or defending any claim that the app infringes a third party's intellectual property rights.
- You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you got NotiAlarm from Google Play, Google Play's terms also apply to your purchase, and Google is not responsible for the app.
15. General
- Governing law. These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-law rules — except that if you live in the EU, UK or another country whose consumer laws give you rights that can't be waived, you keep those rights.
- Changes. We may update these Terms. We'll change the "Last updated" date and, for material changes, tell you in the app or by email before they take effect. If you keep using NotiAlarm after that, the updated Terms apply.
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not transfer these Terms; we may transfer them in connection with a merger, acquisition or sale of assets.
